Additions

As consideration for the services purchased by You and provided to You by westcotthosting.com (westcotthosting.com), You agree to pay westcotthosting.com ( westcotthosting.com ) a monthly or yearly fee. Your monthly or yearly billing date will be determined based on the date on which You Have Purchased a product or Service from us.

You agree that westcotthosting.com ( westcotthosting.com) may pursue all available remedies in order to obtain payment.

You agree that You will be responsible for notifying westcotthosting.com ( westcotthosting.com) should you desire to terminate Your use of westcotthosting.com's ( westcotthosting.com) services. Notification of Your intent to terminate must be provided to westcotthosting.com ( westcotthosting.com) no later than 30 days prior to You billing date. In the absence of notification from You, Hot Safelists.com (hotsafelists.com) will automatically continue Web Hosting services indefinitely and will charge Your Payment Processor You have on file with westcotthosting.com ( westcotthosting.com ), at the rates in which you Subscribed. It is Your responsibility to keep your Payment Processor information current.

In the event You terminate this agreement;

For Safelist Hosting:
Your Safelist (s) Database will be provided to You upon Request emailed to your email address on file, and will be sent in a zip file. It is Not Our Responsibility to upload, transfer or Fttp any of Your Database, log, Html files. banners or anything else connected to Your Safelist(s) being hosting on our domain to a new location.

The Safelist Script Provided to you by us, is Only provided to You during your term of use with westcotthosting.com ( westcotthosting.com) domain Only and will NOT be transferred to any other domain or service.

First payment from Your Payment Processor is considered to be the contractual commitment to retain services and acceptance of terms and conditions.

TERM OF AGREEMENT; MODIFICATIONS
The term of this agreement shall continue in full force and effect as long as westcotthosting.com ( westcotthosting.com ) is providing services to You.

You agree that westcotthosting.com ( westcotthosting.com) may modify this Agreement from time to time. westcotthosting.com (westcotthosting.com) may also discontinue services it provides under this Agreement. c. Modify its pricing through email notification;
d. Terminate Your service for unsolicited, commercial e-mailing (i.e., SPAM); illegal access to other computers or networks (i.e., hacking); distribution of Internet viruses or similar destructive activities;
e. non-payment of services or products provided to you by us;
f. and other activities whether lawful or unlawful that westcotthosting.com ( westcotthosting.com)determines to be harmful to its other customers, operations, or reputation;
g. DISPUTE RESOLUTION POLICY

INDEMNITY
You agree to release, defend, indemnify and hold harmless westcotthosting.com ( westcotthosting.com)and its contractors, agents, employees, offices, directors, shareholders and affiliates from and against any losses, damages or costs, including reasonable attorney's fees, resulting from any claim, action, proceeding, suit or demand arising out of or related in any way to Your account with westcotthosting.com ( westcotthosting.com)and/or Your use of services provided by Hot Safelists.com (hotsafelists.com).

DISCLAIMER OF WARRANTIES.

AGREEABILITY

The remaining terms and conditions of the Agreement will remain in full force and effect.

VENUE; WAIVER OF TRIAL BY JURY
THIS AGREEMENT SHALL BE DEEMED ENTERED INTO IN THE STATE OF MINNESOTA. THE LAWS AND JUDICIAL DECISIONS OF ROSEAU COUNTY, MINNESOTA, SHALL BE USED TO DETERMINE THE VALIDITY, CONSTRUCTION, INTERPRETATION AND LEGAL EFFECT OF THIS AGREEMENT. YOU AGREE THAT ANY ACTION RELATING TO OR ARISING OUT OF THIS AGREEMENT SHALL BE BROUGHT IN THE COURTS OF ROSEAU COUNTY, MINNESOTA.

YOU AGREE TO WAIVE THE RIGHT TO TRIAL BY JURY IN ANY PROCEEDING THAT TAKES PLACE RELATING TO OR ARISING OUT OF THIS AGREEMENT.

NOTICES
You agree that all notices (except for notices concerning breach of this Agreement) from westcotthosting.com ( westcotthosting.com)to You may be posted on our web site. Notices concerning breach will be sent either to the email or postal address you have on file with westcotthosting.com ( westcotthosting.com)s. In either case, delivery shall be deemed to have been made seven (7) days after the date sent.
